California DUI Penalties
When it comes to driving under the influence, California has the harshest penalties in the entire United States. The penalties for the offenses listed below are not aggravated by any other factors. If they are combined, the results can be even more severe.
First DUI Offense:
- Probation: 3 to 5 years of Court probation
- Fines: court fees plus a fine of 1400$ - 1800$
- Loss of drivers license: 6 months
- DUI School: 12 – 45 hours
- Jail time: 48 hours (can be converted to work time)
Second DUI Offense:
- Probation: 3 to 5 years of court probation
- Fines: court fees plus a fine of $1800 -$2800
- Loss of driver license: 18 months
- DUI School: 18 months
- Jail time: 96 hours (can be converted to work time)
Third DUI Offense:
- Probation: 3 to 5 years of Court or FORMAL probation
- Fines: court fees plus a fine of $1800 - $2800
- Loss of drivers license: 3 years
- DUI School: 18 months
- Jail time: minimum 120 days
Forth DUI Offense:
A fourth DUI offense is considered a felony and punishable with up to 3 years in a state prison. The aggravating factors can easily turn a DUI offense into a felony, and it also involves substantial jail time.
